TERMS OF SERVICE

This Terms of Service (“Agreement”) is between the Artist (“I”, “me”) and the Client (“you”) for the creation of a commissioned digital artwork (“Work”). By requesting and paying for a commission, you agree to all terms stated below. Violation of these terms may result in refusal of service, cancellation, or blacklisting.

I. GENERAL TERMS1. I reserve the full right to accept or refuse any commission for any reason.2. Commissions are handled on a first come, first serve basis unless otherwise agreed upon.3. All prices listed are base prices only and may change depending on:  > complexity
  > number of characters (1 additional character = +80%)
  > background details
  > special requests


4. Prices are negotiable, but once agreed upon and paid, the price is final.5. The artwork will be drawn in my personal art style. Style imitation outside my usual range may be refused.6. The client must provide clear, complete references and instructions before I begin. I am not responsible for inaccuracies due to missing or unclear references.7. I am not obligated to replicate another artist’s exact style.8. I am currently balancing commissions with school; delays may occur, but I will communicate clearly.
II. PAYMENT & FEES1. All payments must be made via:
  > GCash (details provided via DM)
  > Paypal (details provided via DM)


2. Payment options:  > Full payment upfront, or
  > 50% upfront to secure a slot, with the remaining 50% required before final delivery.


3. No work will begin until upfront payment is received.4. Finished artwork will not be delivered until full payment is completed.5. Once payment is sent, the commission is considered confirmed and locked in.6. No cancellations or refunds once payment has been made.7. Chargebacks or forced refunds are strictly prohibited and may result in permanent blacklisting.
III. PROCESS & REVISIONS1. I will provide Work-In-Progress (WIP) updates during key stages of the artwork.2. Revisions are allowed only during the sketch and/or base color stage.3. Minor revisions (small adjustments) are allowed within reason.4. Major revisions (pose changes, redesigns, composition changes) may incur additional fees.5. Revisions requested after rendering has started may be refused or charged extra.6. If the client approves a stage and later requests changes to it, this counts as a new revision.7. I am not responsible for unsatisfactory results if no feedback was given during the revision stages.

IV. DEADLINES & TURNAROUND1. Estimated completion time is 3 weeks up to 3 months, depending on:
  > commission type
  > complexity
  > queue size
  > personal schedule


2. Deadlines must be discussed before payment is sent.3. Rush orders may be accepted depending on availability and may include additional fees.4. I will inform the client of any delays or changes to the schedule.
V. DELIVERY1. Finished artwork will be delivered via Google Drive.2. File formats may include:
  > PNG
  > JPEG
  > KRA / IPV (if applicable)


3. This is a digital-only product. No physical items will be shipped.
VI. RIGHTS & USAGE
1. Artist’s Rights  1.1. I retain full copyright, ownership, and intellectual property rights to the artwork unless commercial rights are purchased.


  1.2. I reserve the right to:
    > display the artwork and WIPs on social media, portfolios, and galleries    > use the artwork for self-promotion

  1.3. I may reuse rejected sketches or concepts as long as they do not directly copy the client’s personal character or branding.


2. Client’s Rights (Personal Use)  2.1. The client receives non-exclusive, non-transferable rights for personal use only.  2.2 Personal use includes:    > profile pictures    > banners    > personal posts on social media (with credit)    > personal prints (not for sale)

  2.2.The client must credit me when posting the artwork publicly.  2.3. The client may not:    > claim the artwork as their own    > trace or heavily edit the artwork    > remove or alter my watermark/signature    > resell, redistribute, or give the artwork to third parties

3. Commercial Rights  3.1. Commercial use is NOT included unless explicitly purchased.  3.2. Commercial use includes (but is not limited to):    > monetized content    > merchandise    > branding or logos    > advertisements    > resale or redistribution

  3.3. Commercial pricing:    > Commercial Use: x2 base price
  3.4. Commercial rights must be discussed and paid for before work begins.
VII. INTELLECTUAL PROPERTY & PROHIBITED USES1. The artwork may NOT be used for:
  > AI training
  > machine learning
  > NFTs
  > blockchain projects
  > image generators
  > datasets or for-profit databases
2. Uploading the artwork to AI-related platforms, even for “personal” use, is strictly prohibited.3. Editing, tracing, recoloring for redistribution, or claiming the artwork as one’s own is prohibited.4. Violation of these terms may result in takedown requests and blacklisting.
VIII. CANCELLATIONS & REFUNDS1. No refunds once work has started.2. No cancellations after payment is made.3. Refunds may only be considered if I am unable to start or complete the commission due to unforeseen circumstances.4. Partial refunds may be issued depending on how much work has already been completed.
IX. COMMUNICATION1. Communication will take place via:  *> Instagram DMs
  > Facebook/Messenger DMs
  > TikTok DMs2. The client is responsible for responding in a timely manner. Long delays in replies may affect completion time.


X. FINAL AGREEMENTBy commissioning me, you confirm that you have read and understood these Terms of Service, and you agree to all conditions listed above.
